Terms of Service

These Terms of Service (“Terms”) are an agreement between you and StormFunnel, a service operated by exegov.ai [EXEGOV LEGAL ENTITY NAME — BART TO CONFIRM] (“StormFunnel,” “we,” “us”). By creating an account or using StormFunnel you agree to these Terms and to our Privacy Policy. If you use StormFunnel on behalf of a company, you represent that you are authorized to bind that company, and “you” means the company.
1. The service
StormFunnel monitors public severe-weather alerts issued by the National Weather Service (NWS) for the service areas you configure and, when a qualifying alert matches your area, creates geo-targeted Google Ads campaigns in your own Google Ads account according to the budgets, categories, guardrails, and approval mode you have configured. StormFunnel also provides campaign reporting, spend tracking, email notifications, and campaign recommendations. A free tier provides weather-alert notifications only and does not create campaigns.
StormFunnel is a software tool. We are not an advertising agency, and we do not provide legal, marketing, or professional advice.
2. Eligibility and accounts
- StormFunnel is offered to businesses located in the United States and their authorized representatives. It is not offered to consumers.
- You must be at least 18 years old.
- You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account.
- You may only connect a Google Ads account that you own or are authorized to manage.
3. Your Google Ads account and your ad spend
- All campaigns are created in your own Google Ads account. Google bills you directly for all advertising costs under your agreement with Google. Ad spend is your money and your responsibility; it is separate from and in addition to your StormFunnel subscription fees.
- StormFunnel acts only within the access you grant via Google OAuth and the configuration you set (budgets, caps, categories, approval mode). You can revoke access at any time via your StormFunnel settings or your Google Account security settings.
- You are responsible for the content of your ads and for their compliance with Google Ads policies and all laws applicable to your business and advertising — including state advertising and consumer-protection laws and, where applicable, contractor licensing rules such as license-number display requirements in advertising. StormFunnel generates campaign structures and draft ad copy from your configuration, but you must review and confirm that your ads meet the requirements of every state you advertise in.
- If Google suspends or restricts your Google Ads account, that is a matter between you and Google; StormFunnel cannot create campaigns in a suspended account.
4. Spend guardrails — important disclaimer
StormFunnel lets you configure spend guardrails such as per-campaign budgets, per-category budgets, and monthly caps. These guardrails are best-effort controls, not a guarantee of maximum spend:
- Google Ads may spend up to twice your average daily budget on a given day (Google’s standard overdelivery behavior), although Google states monthly charges will not exceed your daily budget multiplied by the average number of days in a month.
- Reporting delays, API outages, or Google-side behavior can cause actual spend to deviate from the caps configured in StormFunnel.
- You remain responsible for monitoring spend in your Google Ads account. StormFunnel is not liable for advertising costs charged by Google, including costs exceeding a configured guardrail.
5. Free tier and trial
- The free tier provides weather-alert notifications for your service area only. It never creates campaigns or spends money.
- Paid plans include a trial that lasts 30 days or until the first qualifying storm triggers a campaign in your account, whichever comes first (“30 days or first storm”). After the trial ends, your selected plan begins billing unless you cancel first.
- We may modify or discontinue free-tier features or trial terms for new signups at any time.
6. Fees, billing, and cancellation
- Subscription fees are billed in advance through Stripe on a recurring basis at the prices shown at checkout. Prices exclude taxes, which are added where required.
- If a payment fails and your subscription becomes past due, StormFunnel stops publishing new campaigns until payment is resolved. Campaigns already running in your Google Ads account are not deleted by StormFunnel; you can manage them directly in Google Ads at any time.
- You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Upon cancellation StormFunnel pauses the campaigns it manages and stops creating new ones. Your Google Ads account and its campaigns remain yours and under your control in Google Ads.

- We may change prices with at least 30 days’ notice; changes apply from your next billing period.
7. No guarantee of leads or results
Advertising outcomes depend on factors outside our control: the weather, your market, your ad budget, Google’s auction, your website, and your own sales process. StormFunnel does not guarantee any leads, calls, jobs, revenue, rankings, or other business results, and no statement on our site or in our materials should be read as such a guarantee.
8. Weather data
Weather-alert data comes from the National Weather Service and other public sources and is provided “as is.” We do not control and cannot guarantee the accuracy, completeness, or timeliness of NWS alerts, and alerts may be delayed, amended, or cancelled by their issuer. StormFunnel is a marketing tool; it must not be relied on for safety, life-protection, or emergency decisions.
9. Acceptable use
- Do not use StormFunnel to violate any law, Google’s policies, or third-party rights, or to advertise deceptive, fraudulent, or prohibited services.
- Do not attempt to probe, disrupt, reverse engineer, or gain unauthorized access to the service, and do not resell or provide the service to third parties without our written consent.
- We may suspend or terminate accounts that violate these Terms, with notice where practicable.
10. Intellectual property
StormFunnel and its software, design, and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You retain all rights to your business data and to the campaigns and ad content in your Google Ads account. You grant us the limited rights needed to operate the service on your data, as described in the Privacy Policy. Feedback you send us may be used without restriction or obligation.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY QUALIFYING STORM WILL TRIGGER A CAMPAIGN.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA; (B) WE ARE NOT LIABLE FOR ADVERTISING COSTS BILLED TO YOU BY GOOGLE; AND (C) OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE SUBSCRIPTION FEES YOU PAID TO STORMFUNNEL IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM [LIABILITY CAP — LAWYER TO CONFIRM]. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Indemnification
You will defend and indemnify us against third-party claims arising from your ads and their content, your violation of these Terms or of applicable law (including advertising and contractor-licensing rules), or your violation of Google’s policies.
14. Termination
You may stop using StormFunnel and delete your account at any time. We may suspend or terminate the service for material breach of these Terms, for non-payment, or if required by law or by our providers (including Google). Upon termination we pause the campaigns StormFunnel manages, stop creating new ones, and delete your data as described in the Privacy Policy. Sections that by their nature survive (including Sections 7, 11, 12, 13, and 15) survive termination.
15. Governing law and disputes

16. Changes to these Terms
We may update these Terms from time to time. For material changes we will give you at least 14 days’ notice by email or in-app notice before they take effect. Continued use of the service after the effective date constitutes acceptance. If you do not agree, you must stop using the service and may cancel your subscription.
